September 9, 2022 Opinion or Order Filing 7 ORDER: On August 26, 2022, Plaintiff Jonathan A. Tavarez, currently incarcerated on Rikers Island, filed this action pro se pursuant to 42 U.S.C. 1983. (Compl., Doc. No. 2.) On September 9, 2022, the action was transferred to this Court. (Transfer Ord., Doc. No. 4.) The Court grants Plaintiff's request to proceed in forma pauperis pursuant to 28 U.S.C. 1915(a). Plaintiff sues a New York City Police Officer identified solely by his shield number alleging that Plaintiff was wrongfully arrested and that the case against him was dismissed in 2019. (Compl., Doc. No. 2.) The United States Marshals Service will not be able to serve this Defendant without further identifying information. The problem encountered by Plaintiff is a common one as it is frequently difficult for a pro se litigant to identify individual law enforcement officers. In Valentin v. Dinkins, 121 F.3d 72 (2d Cir. 1997) (per curiam), the Second Circuit made clear that a pro se litigant is entitled to assistance from the district court in identifying a defendant. Accordingly, the Court hereby requests the Corporation Counsel for the City of New York to ascertain the full name of the individual whom plaintiff has identified as a New York City Police Officer, Shield No. 952855, employed at the 103rd Police Precinct on January 16, 2017 at 4:11 a.m. (Compl., Doc. No. 2 at 4), and to provide the address where this Defendant can currently be served within 45 days from the date of this Order. Corporation Counsel need not undertake to defend or indemnify this individual at this juncture. This Order merely provides a means by which Plaintiff may name and properly serve the Defendant as instructed by the Second Circuit in Valentin. Once this information is provided, Plaintiff's complaint shall be deemed amended to reflect the full name and shield number of this officer, a summons shall be issued and the Court shall direct service on this Defendant without prepayment of fees. Plaintiff is required to advise the Clerk of Court in writing of any change of address. Failure to keep the Court informed of Plaintiff's current address means the Court will not know where to contact Plaintiff and may result in dismissal of the case. For information regarding court procedures, Plaintiff may contact the Pro Se Office at the United States Courthouse by calling (718) 613-2665. The Clerk of Court is respectfully directed to send a copy of this Order to the Plaintiff and to the Corporation Counsel for the City of New York, Special Federal Litigation Division.
