October 24, 2022 Opinion or Order Filing 6 TRANSFER ORDER: Here, the underlying claim has no connection to the Eastern District of New York. The acts or omissions that allegedly took place occurred at the Otisville Correctional Facility, located in Otisville, New York and at the Woodbourne Correctional Facility, located in Sullivan County, New York and Plaintiff names David Howard, the Superintendent of Woodbourne Correctional Facility as a Defendant. Accordingly, transfer of this action is appropriate. See 28 U.S.C. 1406( a) (if an action is filed in the wrong district court, a court "shall dismiss, or if it be in the interest of justice, transfer such case to any district or division in which it could have been brought."). The Clerk of Court is hereby directed to transfer this action to the United States District Court for the Southern District of New York. 28 U.S.C. 139l(b); 1406(a). No summons shall issue from this Court. The Court notes that a decision on Plaintiffs request to proceed in forma pauperis is reserved for the transferee Court. That provision of Rule 83.1 of the Local Rules of the Eastern District of New York which requires a seven-day delay is waived. SO ORDERED by Magistrate Judge Lois Bloom, on 10/20/2022.
