September 28, 2022 Opinion or Order ORDER -- On September 26, 2022, Petitioner was directed to either indicate by letter that the "child" mentioned in the complaint filed on September 22, 2022 in fact is over the age of 18 or, if the child is a minor, file and serve an amended complaint utilizing only the "child's" initials as required by Fed. R. Civ. P. 5.2(a). See, Electronic Order dated September 26, 2022. On September 27, 2022, Petitioner filed an amended complaint referring to the child by initials only. See, Dkt. Entry No. #6 . However, the amended complaint does not appear to attach any of the exhibits that had been attached to the original complaint, and which the amended complaint still references. Notably, one of the exhibits from the original complaint, which is still referenced in the amended complaint, had listed the minor child's full name. Accordingly, Petitioner is directed to file a corrected amended complaint with any and all necessary exhibits attached, including with any necessary redactions to those exhibits for the minor childs name, by October 5, 2022. Further, defense counsel has filed a notice of appearance, but Petitioner has not filed proof of service of the summons or original complaint (i.e., Dkt. Entry No. #1 ). See, Dkt. Entry No. #5 . Therefore, Petitioner is also directed to file proof of service of the summons and original complaint by October 5, 2022. SO ORDERED by Judge Dora Lizette Irizarry on 9/28/2022. (Carosella, Christy)

September 26, 2022 Opinion or Order ORDER -- Petitioner filed this immigration petition on behalf of her "child" and then sets forth the "child's" full name. Nowhere in the complaint does it state the "child's" age, particularly whether the "child' is a minor. Pursuant to Fed. R. Civ. P. 5.2(a), if an action is brought on behalf of a minor child, the child's full name may not be used. Rather, the child's initials shall be used throughout the case. As the Court cannot discern whether plaintiff's offspring is a minor, plaintiff is directed to either indicate by letter that the "child" in fact is over the age of 18 or file and serve an amended complaint utilizing only the "child's" initials BY NO LATER THAN OCTOBER 3, 2022.
