November 22, 2022 Filing 9 NOTICE with Respect to Complaint Seeking Exoneration from or Limitation of Liability: Notice is hereby given that all persons, firms, entities or corporations, having any claim or suit against the Petitioner with respect to which the Complaint seeks exoneration from or limitation of liability, pursuant to 46 U.S.C. 30501 et seq., shall file their respective claims in writing with the Clerk of this Court, located at the United States District Court for the Eastern District of New York, 225 Cadman Plaza East, Brooklyn, New York 11201, and must deliver or mail a copy thereof to the attorneys for the Petitioner, James E. Mercante, Esq., RUBIN, FIORELLA & FRIEDMAN, LLP, 630 Third Avenue, 3rd Floor, New York, NY 10017, on or before 12/30/2022 or be defaulted, and that if any claimant desires to contest either the right to exoneration from or the right to limitation of liability, such claimant shall file an Answer to the Complaint on or before the aforesaid date, unless the claim has included an Answer to the Complaint, as required by Supplemental Rule F of the Supplemental Rules for Certain Admiralty and Maritime Claims and Asset Forfeiture Actions of the Federal Rules of Civil Procedure, and deliver or mail a copy to the attorneys, or be defaulted. November 22, 2022 Opinion or Order Filing 8 ORDER granting #7 : It is ORDERED that a notice shall be issued by the Clerk of this Court to all persons asserting claims with respect to which the Complaint seeks exoneration and limitation admonishing such persons to file their respective claims with the Clerk of this Court in writing, and to serve on the attorneys for Petitioner a copy thereof on or before 12/30/2022, or be defaulted, and that if any claimant desires to contest either the right to exoneration from or limitation of liability, such claimant shall file and serve upon the attorneys for Petitioner an Answer to the Complaint on or before 12/30/2022, unless the claim has included an Answer to the Complaint, so designated, or be defaulted; and it is further ORDERED that public notice of the aforesaid admonition be given by publication in a widely distributed daily newspaper as provided by Rule F of the Supplemental Rules for Certain Admiralty and Maritime Claims of the Federal Rules of Civil Procedure; and it is further ORDERED that Petitioner shall mail this Order to the person or persons to be restrained in accordance with Supplement Rule F.
