ORDER: This case remains dismissed. In his #6 Amended Complaint, received after this Court dismissed the case, Plaintiff yet again reiterates the same claims previously dismissed for lack of subject matter jurisdiction in both this action and in 22-cv-05579. The Court's 10/26/2022 order dismissing this case stands. Plaintiff is advised that filing the same case again will also result in dismissal and is advised not to do so. Ordered by Judge Pamela K. Chen on 10/28/2022. (SK) |
Filing 6 AMENDED COMPLAINT w/Demand for Trial by Jury against All Defendants, filed by Harold Jean-Baptiste. (File Stamp Date 10/25/2022) (WL) |
ORDER DISMISSING CASE: Plaintiff's #1 Complaint is nearly identical to his Complaint in 22-cv-05579, which the Court dismissed for lack of subject matter jurisdiction on October 19, 2022. See Jean-Baptiste v. Montway, 22-cv-05579 (Dkt. 22, 24). All of the grounds for the Court's dismissal in that case pertain to this Complaint, which alleges the same facts and causes of action as the prior Complaint, as well. Therefore, this case is dismissed for lack of subject matter jurisdiction. The Clerk of Court is respectfully requested to enter judgment accordingly and terminate this action. Ordered by Judge Pamela K. Chen on 10/26/2022. (SK) |
