A conclusory assertion of "conflicts with the witness' schedule" making him unavailable to be deposed at any time between the fall of 2022 and now is insufficient to extend the schedule, especially when doing so would have a cascading effect on the other dates. Defendant may renew this motion if it can demonstrate why the witness was not deposed earlier and what he's doing over the next 45 days that is more important than this case. Further, plaintiff's counsel is advised that by not calling this problem to the Court's attention until five days before the discovery cut off, plaintiff may have waived this deposition.
