December 2, 2022 Opinion or Order ORDER: Defendant requests an adjournment of the initial conference and that the Court set discovery deadlines "for dates after Continental's motion [to dismiss] is determined." ECF No. #8 at 1-2. Construed as a motion to stay all discovery, the request is denied without prejudice. Defendant's motion to dismiss, even if granted, would only result in dismissal of plaintiff's bad faith claims, ECF No. 4 at 2, and would not dispose of the underlying breach of contract claim. See CT Espresso LLC v. Lavazza Premium Coffees Corp., No. 22-CV-377 (VSB), 2022 WL 1639485 at *2 (S.D.N.Y. May 24, 2022) (denying motion to stay discovery where the party seeking stay filed a partial motion to dismiss which would not resolve the entire action).The Court shall hold the initial conference on December 8, 2022, at 10:00 a.m. in Courtroom 11A South as scheduled.
