This is a federal question case because it is brought against a corporation, the stock of which is more than 50% owned by the United States. See 28 U.S.C. 1349. Plaintiff's counsel would have realized this if he had read the Notice of Removal, which cites the statute. In addition, plaintiff's counsel has offered no adequate explanation as to why he failed to comply with the mandatory requirements in this Court's scheduling order.Plaintiff's counsel is therefore sanctioned in the amount of $400 for violating Rule 11 and 16(f), payable to the Clerk of the Court within 7 days with proof of payment filed in this action, failing which this action will be dismissed.
