Filing 7 ORDER: The Court's records reflect that the Complaint in this action was filed on January 17, 2023. Rule 4(m) of the Federal Rules of Civil Procedure provides that if a defendant is not served with the complaint and a summons within 90 days after the complaint is filed, the court must dismiss the action without prejudice against that defendant. Accordingly, if proper service of the Complaint and Summons is not made upon the Defendants by April 17, 2023, or if Plaintiffs fail to show good cause as to why such service has not been made, I will recommend that the District Judge dismiss this action without prejudice. After Defendants have been served, Plaintiffs must file with the Court proof of service of the Complaint and Summons. So Ordered by Magistrate Judge Sanket J. Bulsara on 3/9/2023. (MD) |
