ORDER: The Court shall hold the initial conference in this diversity case on May 2, 2023, at 10:30 a.m. in Courtroom 11A South of the United States Courthouse, 225 Cadman Plaza East, Brooklyn, New York. The parties shall exchange their Rule 26(a)(1) initial disclosures and file their Rule 26(f) Meeting Report with the Court by April 25, 2023. Parties are advised that they must contact each other before making any request for an adjournment to the Court. ORDER: Federal Rule of Civil Procedure 10(a) provides that [t]he title of the complaint must name all the parties. Nevertheless, a district court has discretion to permit a plaintiff to proceed anonymously if, after balancing several factors, it determines that the plaintiffs need for anonymity outweighs the countervailing interests in full disclosure. Sealed Plaintiff v. Sealed Defendant, 537 F.3d 185, 18990 (2d Cir. 2008) (listing ten non-exhaustive factors for courts to consider). But a plaintiff is not entitled to proceed anonymously as of right. See id. at 19091. Accordingly, by 4/28/2023, plaintiff is directed either to file a motion to proceed anonymously or to amend his complaint to reflect his actual name. Ordered by Judge Rachel P. Kovner on 3/28/2023.
