ORDER denying #20 Motion to Remand to State Court -- Defendants Mega Mart LLC and Moshe Landau filed a motion #20 on April 28 that they designated as a "Motion to Remand to State Court" on ECF, despite this case not having been removed from state court. As an alternative, the defendants move for dismissal under Federal Rules of Civil Procedure 12(b)(1) and 12(b)(6). The defendants filed this motion without requesting a pre-motion conference, as required by Rule III.B.1 of this Court's Individual Rules and Practices. Accordingly, the defendants' motion is denied as premature with leave to renew. If they intend to proceed with a motion to dismiss, the defendants are ordered to file a pre-motion letter on or before May 22. The parties' pre-motion letters may address whether this Court has supplemental jurisdiction over Plaintiffs' non-FLSA claims. See, e.g., Shibetti v. Z Rest., Diner & Lounge, Inc. , 478 F. Supp. 3d 403, 408 (E.D.N.Y. 2020) (declining to exercise supplemental jurisdiction over claims that the court concluded had "nothing to do with whether plaintiffs were paid the minimum wage and overtime as required under the FLSA").
