Filing 6 SUA SPONTE REPORT AND RECOMMENDATION: Defendant removed plaintiff's personal injury case from Kings County Supreme Court on March 20, 2023, invoking the Court's diversity jurisdiction under 28 U.S.C. 1332. ECF No. #1 . On April 3, 2023, the Court ordered defendant to show cause by April 17, 2023 why this matter should not be remanded to state court for lack of subject matter jurisdiction. In light of defendant's failure to respond to the Court's Order to Show Cause, it is respectfully recommended that this action should be remanded to state court. See attached Report & Recommendation.
