June 6, 2023 Opinion or Order ORDER: The Court has received Defendant's letter indicating that the parties have reached a settlement in principle. See ECF No. #13 . The parties shall file a stipulation of voluntary dismissal on or before July 6, 2023, or else they shall file on that date the joint letter and case management plan required by the Court's prior scheduling order. See ECF No. #8 . If the parties fail either to dismiss the case or to file a case management plan on or before July 6, 2023, then the Court will promptly enter a discovery schedule allowing no more than 90 days for fact discovery without seeking further input from the parties. May 26, 2023 Opinion or Order ORDER: The Court previously ordered the parties to file a joint letter indicating whether Plaintiff would agree to seek less than the amount of damages necessary to meet the amount-in-controversy threshold of 28 U.S.C. 1332 and if Defendant would consent to the case being remanded to state court on that basis. Plaintiff has responded with a letter indicating that she is interested in settling the case, that Defendant's insurance carrier is willing to pay up to the $25,000 limit of its policy, but that Plaintiff is inquiring whether Defendant has additional insurance coverage in excess of that amount. See ECF No. #11 . Since Plaintiff is apparently seeking additional sources of funds from which to recover damages, the Court cannot conclude that Plaintiff's complaint, which alleges that Plaintiff is entitled to $5 million in damages, fails to satisfy the requirements for diversity jurisdiction. The Court therefore, at this point, declines to remand the case to state court.The parties shall file their joint letter describing the case and proposed case management plan on or before June 6, 2023, as required by the Court's prior scheduling order. See ECF No. #8 . The Court will not adjourn that deadline or exempt the parties from their discovery obligations merely because Plaintiff is pursuing settlement opportunities. If the parties do not submit a proposed case management plan by June 6, 2023, then the Court will promptly enter a discovery schedule allowing no more than 90 days for fact discovery without seeking further input from the parties. May 22, 2023 Opinion or Order ORDER: Based on the Court's review of Defendant's notice of removal and the parties' letters, the Court concludes that this case was properly removed from state court. See ECF Nos. #3 , #9 , #10 . However, Plaintiff has argued that the amount-in-controversy requirement is not satisfied because the coverage limit of Defendant's insurance policy is $25,000, and although Defendant correctly notes that the damages alleged in Plaintiff's complaint exceed that amount and, therefore, provide a basis for diversity jurisdiction, Defendant has offered to consent to the remand of this case if Plaintiff agrees in writing to limit the damages he seeks to $25,000. The parties shall file a joint letter on or before May 26, 2023, indicating whether they jointly agree to the Court's remanding this case based on Plaintiff's stipulation to seek an amount of damages less than the amount-in-controversy requirement. Plaintiff's letter must address not only whether the Court has diversity or federal question jurisdiction over the claims at issue in this case, but also whether Defendant complied with the procedural requirements for removal, including the requirements in 28 U.S.C. 1446.
