Minute Entry for Initial Conference proceedings held on 7/19/2023 before Magistrate Judge James R. Cho. Appearances by Julie Cohen Lonstein for plaintiff; Paula A. Miller for defendants. Case discussed. Defendants granted leave to file an amended answer by 7/26/2023. In light of defendants' anticipated amended answer, by 7/19/2023, plaintiff shall withdraw its "motion to dismiss counterclaims" #13 without prejudice. The Court advised plaintiff's counsel to review the assigned District Judge's Individual Rules prior to filing any future dispositive motions. The Court entered the following pretrial schedule: parties to exchange automatic disclosures by 8/2/2023; no amendment of the pleadings or joinder of additional parties permitted after 9/30/2023 without good cause; and parties to complete fact discovery by 2/1/2024. Parties do not anticipate retaining experts. The Court will enter a deadline for commencing dispositive motion practice near the end of discovery, if necessary.Telephonic settlement conference scheduled for 10/3/2023 at 1:00 p.m. before Magistrate Judge James R. Cho. The parties are directed to call toll free (888) 808-6929 and use access code 106-5334. Clients shall be readily available by telephone throughout the conference.The parties are directed to submit ex parte settlement letters by 9/26/2023, which may be forwarded by ex parte email to Chambers at cho_chambers@nyed.uscourts.gov (note that there is an underlined space between cho and chambers). The ex parte settlement letters shall state (1) the status of settlement discussions; (2) the last demand and offer made, if any; (3) the strengths and weaknesses of the case; and (4) any information that may assist the Court in helping the parties resolve the matter. The parties are encouraged to discuss settlement prior to submission of the ex parte letters. The ex parte letters shall be limited to five pages exclusive of attachments.If the parties do not believe a settlement conference would be productive at that time, by 9/26/2023, parties shall submit a joint letter requesting that the settlement conference be converted to a status conference.
