June 22, 2023 Opinion or Order ORDER TO SHOW CAUSE: Plaintiff's #1 Complaint, filed in the Eastern District of New York on 05/26/2023, appears to accuse Defendant New York City Campaign Finance Board of race and sex discrimination in connection with her run for Public Advocate.Although the Complaint asserts, in conclusory fashion, that the conduct complained of occurred while Defendants were "working from home" in Kings County (Compl., Dkt. 1, at ECF 9), it is not apparent from the face of the pleading that any of the alleged violations actually occurred in this District. Plaintiff resides in Manhattan, and she provides Manhattan addresses for all the Defendants. Moreover, the OATH hearings referenced in her Complaint took place in Manhattan. Accordingly, Plaintiff is directed to show cause by written affirmation on or before 07/21/2023 why this case should not be transferred to the United States District Court for the Southern District of New York. If Plaintiff fails to show cause in writing within the time allowed or fails to seek an extension of time, the Court will transfer this action to the Southern District of New York. In light of this Order, Defendants' #10 motion for an extension of time to answer Plaintiff's complaint is denied as moot. Defendants' deadline to answer is adjourned sine die until Plaintiff shows cause as to why the Eastern District of New York is the proper venue for this action. Ordered by Judge Pamela K.
