ORDER: The Court is in receipt of the #14 stipulation of dismissal with respect to defendant New York City Department of Housing Preservation and Development. The stipulation invokes Federal Rule of Civil Procedure 41(a)(1)(A)(ii), but New York City Environmental Control Board, also an appearing defendant in this action, has not signed the stipulation. The stipulation is thus not signed by all parties who have appeared, and dismissal is not appropriate under Rule 41(a)(1)(A)(ii). Accordingly, the Court construes the stipulation of dismissal as a request for court-ordered dismissal pursuant to Rule 41(a)(2). Defendants may file any objection by 8/10/2023. In the absence of an objection, the action will be dismissed against New York City Department of Housing Preservation and Development without prejudice. Ordered by Judge Rachel P.
