August 7, 2023 Opinion or Order Minute Entry and Order: A telephonic Status Conference was held on 8/7/2023 before Magistrate Judge Taryn A. Merkl. Appearances by Plaintiffs Teresa Buie and Tamara Buie, pro se, and Andrew Levitt for Defendant. As stated on the record, in light of the fact that this case was removed from state court prior to the filing of a complaint, Defendants indicated that they may be seeking to file a motion to dismiss on res judicata and other grounds depending upon the allegations at issue in the case. The Court declines to set a discovery schedule at this time. Plaintiffs are directed to file a complaint by 8/11/2023 setting forth a short and plain, factual statement of their claims. See Fed. R. Civ. P. 8. The Court reminds Plaintiffs that they may contact the E.D.N.Y. Pro Se Office for assistance with filing the complaint, and that they may sign up for electronic ECF notification. Defendants are respectfully directed to continue to serve Plaintiffs by mail, for the reasons discussed. Defendants shall amend their answer, move, or otherwise respond to the complaint by 9/1/2023. July 25, 2023 Opinion or Order ORDER denying #11 Motion for TRO. The plaintiff's request for a temporary restraining order or preliminary injunction #11 does not set forth a factual or legal basis for the requested relief. Given this lack of foundation, the motion is denied without prejudice as to renewal. Under the standard set forth in this Circuit, the plaintiff must demonstrate "1) irreparable harm absent injunctive relief; 2) either a likelihood of success on the merits, or a serious question going to the merits to make them a fair grout for trial, with a balance of hardships tipping decidedly in the plaintiff's favor; and 3) that the publics interest weights in favor of granting an injunction." Metro. Taxicab Bd. of Trade v. City of New York, 615 F.3d 152, 156 (2nd Cir. 2010); see also Doe v. Livanta LLC, 489 F.Supp.3d 11, 16 (E.D.N.Y. 2020). Ordered by Judge Ann M. Donnelly on 7/25/2023.
