PRELIMINARY INJUNCTION: IT IS ORDERED that, pending a final disposition of this action, Defendants are permanently restrained and enjoined from violating Section l 7(a) of the Securities Act [15 U.S.C. 77q(a)] in the offer or sale of any security by the use of any means or instruments of transportation or communication in interstate commerce or by use of the mails, directly or indirectly: (a)to employ any device, scheme, or artifice to defraud;(b) to obtain money or property by means of any untrue statement of a material fact or any omission of a material fact necessary in order to make the statements made, in light of the circumstances under which they were made, not misleading; or (c)to engage in any transaction, practice, or course of business which operates or would operate as a fraud or deceit upon the purchaser. By August 25, 2023 counsel shall submit a agreed upon briefing schedule as to the issue of whether the defendant can access investor funds to use for attorney's fees and living expense. | Minute Entry for proceedings held before Judge Frederic Block: Telephone Conference held on 7/29/2023: The parties attended an informal, off-the-record telephone conference at 10:00 am on Saturday, July 29 to discuss the SECs order to show cause and request for a temporary restraining order. Defense counsel represented to the Court that they have advised Defendant to keep his funds in place, that no funds from the bank accounts in question are being deployed, and that they have an accurate accounting of the relevant accounts. If Defendant does not abide by Counsels recommendation, the Court will contact the US Attorneys office to recommend potential criminal prosecution.
