ORDER: the #5 motion for a temporary restraining order is denied. Under Federal Rule of Civil Procedure 65(b)(1)(B), a court may not issue a temporary restraining order without notice to the adverse party unless the movant certifies in writing any efforts made to give notice and the reasons why it should not be required. Fed. R. Civ. P. 65(b)(1)(B). There is no indication that defendants have been served with the #1 complaint or the #5 motion, and plaintiffs affidavit neither states any efforts he made to notify the defendants of his motion nor provides reasons why notice should not be required. See Affidavit in Supp. With respect to plaintiffs application for a preliminary injunction, plaintiff is directed to serve defendants with the #1 complaint, all papers associated with the #5 motion, and this order, and to file proof of service on the docket by 9/13/2023.
