October 24, 2023 Opinion or Order ORDER: The Court denies Plaintiff's #11 motion to reopen pursuant to the Court's #6 Memorandum and Order dismissing Plaintiff's #1 Complaint for lack of subject matter jurisdiction. Plaintiff provides no basis for reconsideration of that dismissal or for re-opening this matter. The Court has reviewed the Amended the Complaint [11-1] that she filed with her motion and finds that it still does not allege facts establishing subject matter jurisdiction over this matter, i.e., there is no diversity jurisdiction nor federal-question jurisdiction. Accordingly, this matter remains closed. The Court further notes that Plaintiff has already noticed an appeal of the Court's dismissal order, and requested in forma pauperis status for that appeal, which the Court denied. October 13, 2023 Opinion or Order ORDER: On September 13, 2023, this Court dismissed Plaintiff's #1 Complaint for lack of subject matter jurisdiction pursuant to Fed. R. Civ. P. 12(h)(3) and 28 U.S.C. 1915(e)(2)(B). (Dkt. #6 .) Judgment was entered on September 14, 2023. (Dkt. #7 .) On October 12, 2023, Plaintiff filed her #9 motion to proceed in forma pauperis on appeal. A Court may deny in forma pauperis status for an appeal if it finds that the appeal would not be taken in good faith and articulates such findings in writing. 28 U.S.C. 1915(a)(3) ("An appeal may not be taken in forma pauperis if the trial court certifies in writing that it is not taken in good faith."). The standard for "good faith" in pursuing an appeal is objective. See Coppedge v. United States, 369 U.S. 438, 445 (1962) ("We consider a defendant's good faith... demonstrated when he seeks appellate review of any issue not frivolous."). Here, Plaintiff has failed to demonstrate a basis to support this Court's subject matter jurisdiction and the Court, in its previous #6 Order, denied in forma pauperis status for purposes of appeal. Accordingly, Plaintiff's #9 motion for leave to proceed in forma pauperis on appeal is denied without prejudice to her ability to seek the same relief in the United States Court of Appeals for the Second Circuit.
