ORDER granting #14 parties' request to set aside the default judgment entered against Defendants on September 8, 2023 by the Supreme Court of the State of New York, Kings Country, prior to the removal of this action to this Court. See Marks v. Blount-Lee, No. 16-CV-3524, 2017 WL 3098094, at *2-3 (E.D.N.Y. July 20, 2017) ("A default judgment previously entered by a state court may . . . be set aside by a federal court pursuant to Federal Rules 55(c) and 60(b)(4) after the case has been removed."); Munsey v. Testworth Labs., 227 F.2d 902, 903 (6th Cir. 1955) (holding that a state court default judgment was subject to the possibility of being set aside in the federal court after removal). Pursuant to the parties' stipulation and agreement and Federal Rule of Civil Procedure 41(a)(1)(A)(ii), the Court dismisses the action without prejudice. Ordered by Chief Judge Margo K.
