ORDER: Defendant's counsel has now called chambers on two separate occasions. The Court's Individual Practices prohibit such phone calls. (Individual Practices of Magistrate Judge Sanket J. Bulsara, I.B ("[E]xcept for deposition disputes, telephone calls to chambers are otherwise prohibited.")). And despite being warned by Court staff to file a letter and not call again, he again placed a phone call to chambers. The Court does not permit counsel to attempt to engage in ex parte advocacy and does not take lightly haranguing of Court personnel. Further violations of the Court's rules may lead to imposition of sanctions or referrals to the disciplinary committee of the Bar of this Court. So Ordered by Magistrate Judge Sanket J. ORDER TO SHOW CAUSE: Defendant is ordered to show cause as to why this case should not be remanded back to state court. The incomplete notice of removal indicates that this action was first filed in the Commonwealth of Virginia, and as such, the case should have been removed to a federal court in Virginia, not in New York. See 28 U.S.C. s. 1441(a)([A]ny civil action brought in a State court... may be removed... to the district court of the United States for the district and division embracing the place where such action is pending.). Defendant must demonstrate why removal to this Court is proper, by submitting a letter no longer that 2 pages by 10/20/2023.
