November 15, 2023 Opinion or Order Minute Entry and Order: A telephonic Initial Conference was held on 11/15/2023 before Magistrate Judge Taryn A. Merkl. Appearances by Matthew Greenberg for Plaintiff and John Dematteo, III for Defendants. The Court reminded the parties of their obligations to preserve and, if appropriate, produce electronically stored information during discovery. As stated on the record, the parties' discovery plan is adopted, in part, as follows. Rule 26(a) initial disclosures and any HIPAA-compliant records authorizations shall be exchanged by 12/1/2023. First requests for documents and interrogatories shall be exchanged by 12/4/2023. Phase I discovery shall be completed by 2/2/2024. The deadline for joining additional parties and amending the pleadings as of right is 3/1/2024. Fact discovery shall be completed on or before 3/22/2024. The parties are directed to file a joint status report certifying the close of fact discovery by 3/29/2024. Exchange of expert disclosures shall be completed by 4/26/2024. Expert depositions and exchange of rebuttal expert reports shall be completed by 5/24/2024. All expert discovery shall be completed by 5/31/2024, and certification of the completion of all discovery shall be filed on ECF by 6/7/2024. The last date to take the first step in dispositive motion practice is 7/8/2024, and must be done in accordance with my Individual Rules. The parties are directed to file a joint status report by 2/16/2024, including an update as to their progress on discovery, any settlement discussions, and whether the case should be referred for mediation or a settlement conference before the Court. As discussed at the conference, this case has been assigned to a Magistrate Judge pursuant to the Court's Direct Assignment Pilot Program, which is governed by Administrative Order 2023-23. The Administrative Order, answers to Frequently Asked Questions about the Pilot Program, information about consenting to a Magistrate Judge, and a biography of the Magistrate Judge assigned to this case are on the Courts website at # https://www.nyed.uscourts.gov/edny-direct-assignment-pilot-program.
