Filing 6 ORDER: Pro se plaintiff filed these three actions against the same defendants that are pending before this Court. Plaintiff, an employee of the United States Postal Service, alleges that defendants violated his right to due process under the 5th Amendment to the United States Constitution by placing him on emergency "off-duty status" from December 7-9, 2022 (23-CV-4470 and 23-CV-8472) and by "overload[ing]" his work schedule on December 15, 2023 (23-CV-8342).Plaintiff filed the first action, 23-CV-4470, in June 2023. However, plaintiff has not yet properly served defendants and filed proof of proper service in that action. ECF Nos. 9, 13. In November 2023, plaintiff paid the filing fee to commence two additional actions, 23-CV-8472 and 23-CV-8342. Plaintiff has spent more money to file these three complaints and now to hire a process server than what he seeks to recover in this matter. Plaintiff should not file additional cases but should focus on properly serving the defendants in his first action, 22-CV-4470, by January 8, 2024, as directed in this Order, as the other two cases are largely duplicative of his first complaint. See attached Order. Ordered by Magistrate Judge Lois Bloom on 12/7/2023. (VP) |
