Filing 11 NOTICE of Appearance by Joshua Samuel Sohn on behalf of All Plaintiffs (aty to be noticed) (Sohn, Joshua) |
ORDER: Federal Rule of Civil Procedure 10(a) provides that "[t]he title of the complaint must name all the parties." Nevertheless, a district court has discretion to permit a plaintiff to proceed anonymously if, after balancing several factors, it determines that "the plaintiff's need for anonymity" outweighs the "countervailing interests in full disclosure." Sealed Plaintiff v. Sealed Defendant, 537 F.3d 185, 189-90 (2d Cir. 2008) (listing ten non-exhaustive factors for courts to consider). But a plaintiff is not entitled to proceed anonymously as of right. See id. at 190-91. Accordingly, by 12/27/2023, plaintiff is directed either to file a motion to proceed anonymously or to amend her complaint to reflect her actual name. Ordered by Judge Rachel P. Kovner on 11/29/2023.
