January 3, 2024 Opinion or Order ORDER: The Court declines to adopt the proposed case management plan filed by Plaintiff, which Plaintiff represents that Defendants did not participate in preparing because Defendants have not yet appeared. See ECF No. #8 . Defendants' deadline to answer or otherwise respond to the complaint is January 19, 2024. Plaintiff shall attempt to confer with Defendants, and the parties shall file a jointly proposed case management plan and joint letter describing the case by that date. The Court likely will not provide the parties the approximately six months of fact discovery requested in Plaintiff's proposed case management plan unless the parties explain with specificity in their joint letter why they need more than 90 days to complete fact discovery. If the parties do not submit a jointly proposed case management plan by January 19, 2024, then the Court will promptly enter a discovery schedule allowing no more than 90 days for fact discovery without seeking further input from the parties. As the Court stated in its prior order, although the Court will be amenable to a reasonable extension of Defendants' deadlines to answer or otherwise respond to Plaintiff's complaint, the Court will require the parties to demonstrate additional good cause to adjourn the deadline for filing the joint letter and proposed case management plan required by this order because the Court does not need Defendants' answers to set a discovery schedule. Ordered by Judge Hector Gonzalez on 1/3/2024. (BH)

Requests for adjournment of the deadline for these submissions will be considered only if made in writing and otherwise in accordance with Section I.D of the Court's Individual Practices. Plaintiff's counsel shall notify Defendants' counsel of this scheduling order, in writing, as soon as reasonably possible.Although the Court will be amenable to a reasonable extension of Defendants' deadlines to answer or otherwise respond to Plaintiff's complaint, the Court will require the parties to demonstrate additional good cause to adjourn the deadline for filing the joint letter and proposed case management plan required by this order because the Court does not need Defendants' answers to set a discovery schedule.
