November 29, 2023 Opinion or Order ORDER DISMISSING CASE: The Court is in receipt of plaintiffs #4 letter requesting that... this case be put on hold or cancelled at this time so that plaintiff can seek relief through an Article 78 proceeding in New York state court. Letter 1 (Dkt. #4). The Court construes the letter as a notice of dismissal pursuant to Federal Rule of Civil Procedure 41(a)(1)(A)(i). So construed, the request is granted and this action is dismissed without prejudice. Plaintiff has not paid the filing fees in this action and, because the action is dismissed without prejudice, plaintiff may refile his complaint in a new action if he so chooses. The Clerk of Court is respectfully directed to mail a copy of this Order to plaintiff. Ordered by Judge Rachel P. Kovner on 11/29/2023. (NNW)
