ORDER: The court is in receipt of #5 Letter filed by Plaintiffs' counsel in response to the Court's December 5, 2023, Order to Show Cause, clarifying the domicile of one of the two plaintiffs. Plaintiffs' response did not provide additional detail regarding the domicile of the other named plaintiff nor a statement regarding losses or damages. Pursuant to this Court's December 5, 2023, Order to Show Cause, the parties were ordered to respond no later than December 15, 2023 as to why this action should not be remanded to state court for lack of diversity jurisdiction. Defendant Home Depot has failed to comply with this Court's Order to Show Cause. If Defendant does not address the Court's concerns outlined in the Order to Show Cause by December 20, 2023, this action will be remanded to state court. Ordered by Judge Kiyo A. ORDER TO SHOW CAUSE re #1 Notice of Removal, filed by Home Depot U.S.A., Inc. The parties are ordered to show cause no later than December 15, 2023, why this action should not be remanded to state court for lack of diversity subject matter jurisdiction given the lack of detail regarding Plaintiffs' alleged losses or damages in the complaint. See Minaudo v. Sunrise at Sheepshead Bay, No. 22-CV-2579(EK)(RLM), 2023 WL 110359, at *3 (E.D.N.Y. Jan. 5, 2023) (collecting cases remanded for failure to establish amount in controversy, even where permanent, serious, and fatal injuries were alleged because allegations did not particularize extent of injuries or damage). The Court further notes that to the extent the removing defendant relies on a settlement demand from a plaintiff, "settlement demands generally are not reliable indicators of the amount in controversy." Elzoghary v. Zelaya-Monge, No. 23-CV-5353(DLI)(PK), 2023 WL 6121800, at *2 (E.D.N.Y. Sept. 19, 2023). If Defendant intended to represent that it received this monetary demand in response to a N.Y. C.P.L.R. 3017(c) supplemental demand, it shall so specify in its response to this order.Finally, the Court notes that the complaint is silent to Plaintiffs' domicile, specifying only that Plaintiffs are "residents" of New York. "[A]llegations of residency alone cannot establish citizenship." Canedy v. Liberty Mutual Ins. Co., 126 F.3d 100, 103 (2d Cir. 1997). As such, the parties shall also clarify the domicile of Plaintiffs in the response to this order.The parties shall respond to this order to show cause via ECF by December 15, 2023.
