February 12, 2024 Opinion or Order SCHEDULING ORDER: On January 8, 2024, the Court granted the plaintiff leave to file an amended complaint by February 7, 2024. The plaintiff did not do so. Given the plaintiff's pro se status, the Court sua sponte extends the filing deadline to February 26, 2024. This is the plaintiff's first extension. If the plaintiff does not file an amended complaint within the time allowed or show good cause for an extension, the Clerk of Court may be directed to enter judgment and close this case. January 8, 2024 Opinion or Order Filing 4 MEMORANDUM AND ORDER. The plaintiff's action is dismissed without prejudice. The plaintiff has 30 days to file an amended complaint, which must be captioned Amended Complaint and bear the same docket number as this order: 23-CV-9508 (AMD) (LB). The plaintiff is advised that the amended complaint completely replaces the original complaints. That is, the amended complaint must stand on its own without reference to the original complaints. All further proceedings will be stayed for 30 days. If the plaintiff does not file an amended complaintwithin the time allowed or show good cause for an extension to file the amended complaint, the Court will direct the Clerk of Court to enter judgment and close this case. The plaintiff may contact the City Bar Justice Center's Federal Pro Se Legal Assistance Project at (212) 382-4729 for free, confidential, limited-scope legal assistance. The Court certifies pursuant to 28 U.S.C. 1915(a)(3) that any appeal from this Order would not be taken in good faith. Therefore, in forma pauperis status is denied for purposes of an appeal. The Clerk of Court is respectfully directed to consolidate the above-captioned actionsunder No. 23-CV-9508, the first filed action, to close No. 23-CV-9509, and to direct all future filings in either case to No. 23-CV-9508. The Clerk of Court is also respectfully directed to mail a copy of this Memorandum and Order to the plaintiff along with a complaint form and to note the mailing on the docket.
