March 11, 2024 Opinion or Order ORDER re: #10 . Defendant's portion of this letter is so superficial that it violates Rule 16(f) and is therefore sanctionable. Plaintiff has given specific dates and amount of pay that plaintiff was allegedly paid over particular time periods. It is not enough for defendant to say plaintiff's hours were "inflated." If defendant has time records of what plaintiff was paid, they should have been summarized in this letter. If defendant has no time records, it needs to say so, which has consequences in itself. If defendant provided the required statutory notices to plaintiff, which it doesn't mention at all, then it needs to say that. To avoid sanctions, defendant is directed to file a supplemental letter that actually engages plaintiff's allegations prior to the conference. Ordered by Judge Brian M. Cogan on 3/11/2024. (PW)
