March 26, 2024 Opinion or Order ORDER: The Court grants Plaintiff's request for leave to file an amended complaint, see ECF No. #8 , that attempts to address the issues raised in Defendant's pre-motion letter regarding Defendant's proposed motion to dismiss, see ECF No. #7 . Plaintiff has not previously amended the complaint, and Plaintiff has requested permission to amend less than 21 days after Defendant filed a pre-motion letter, as authorized by Rule 15(a)(1). The Court therefore denies Defendant's request for a pre-motion conference.Plaintiff shall file an amended complaint on or before April 9, 2024. Defendant shall file a short letter on or before April 16, 2024, indicating whether Defendant intends to move to dismiss Plaintiff's amended complaint. Defendant's letter need not reiterate the legal and factual bases for Defendant's planned motion to dismiss, and Plaintiff shall not file a responsive letter.If Defendant decides to move to dismiss Plaintiff's amended complaint, then Defendant shall file opening papers in support of the motion on or before May 9, 2024. Plaintiff shall file opposition papers on or before June 10, 2024, and Defendant shall file reply papers on or before June 24, 2024.
