April 16, 2024 Opinion or Order ORDER denying #11 Motion for Extension of Time to File Response/Reply #10 MOTION to Dismiss -- It is abundantly clear that none of the parties in this case have familiarized themselves with my Rules, the Local Rules of the Court or the Federal Rules of Civil Procedure. As an initial matter, Local Rule 6.1(b) requires that responses to motions to dismiss in lieu of an answer must be made within fourteen (14) days of service of the motion, which in this case was April 10, 2024. As such, the request for an extension was made late.Secondly, Section II(D) of my Individual Rules require that any requests for extensions of deadlines must be made at least three (3) days prior to the deadline the parties seek to extend. Again, the request was made five (5) days after the deadline.Finally, what the parties filed as a "motion" in fact was a stipulation by and among the parties to extend the briefing schedule as a fait accompli, and not really requesting leave of the Court. As stated above, it violates my Individual Rules, which require that the request be made by LETTER MOTION NOT STIPULATION, and include, among other things: the reason for request, the original deadline, the number of previous extension requests and whether they were granted or denied, whether the adversary consents and why if not, and the reason for the extension. In other words, the parties may not just agree among themselves to extend a deadline, but rather must seek true leave of the Court and provide good cause for the application.Accordingly, the request for the extension is denied without prejudice to renew by April 22, 2024 in a manner that complies with this Order. March 21, 2024 Opinion or Order ORDER STRIKING #9 Motion to Dismiss -- Defendants LVNV Funding, LLC and Kirschenbaum & Phillips, P.C. ("Defendants") clearly have not familiarized themselves with the Court's Individual Rules specifying that previously filed documents should not be attached as exhibits, but rather referred to by their docket entry numbers. See, Judge Irizarry's Individual Rules and Practices ("Individual Rules"), Section IV(D). In addition, Defendant's motion relies on documents that are not included within for the four corners of the complaint, which is discussed further below. For these reasons, Defendants' Motion to Dismiss is STRICKEN with leave to refile.Defendants are reminded that, under the applicable standard for a motion to dismiss under Fed. R. Civ. P. 12(b)(6), the Court's "review is limited to the facts as asserted within the four corners of the complaint, the documents attached to the complaint as exhibits, and any documents incorporated in the complaint by reference." McCarthy v. Dun & Bradstreet Corp., 482 F.3d 184, 191 (2d Cir. 2007). To the extent that Defendant's memorandum of law relies on documents that are beyond the four corners of the complaint, the grounds for their consideration must be supported by appropriate legal precedent. Defendants are on notice that the motion may be stricken again if the Court cannot properly consider cited materials that are outside the four corners of the complaint at this stage.By NO LATER THAN APRIL 3, 2024 Defendants shall file a proper motion that complies with the Court's Individual Rules, the Court's Local Rules and the Fed. February 22, 2024 Opinion or Order ORDER: In the notice of removal #1 , Defendants note that "removal is timely... because Defendant has filed this Notice of Removal within 30 days of its receipt of Plaintiff's Complaint." However, Defendants do not specify the date on which they received service of the summons and complaint. Defendants are directed to submit a supplemental filing by 3/6/2024 indicating the date of service.
