May 23, 2024 Filing 8 Minute Entry for proceedings held before Magistrate Judge Peggy Kuo. Initial Conference held on May 23, 2024. Christina Hall, Esq. appeared on behalf of plaintiff. Allyson Belmont, Esq. appeared on behalf of defendants. The Court noted that the verified complaint [1-1] is entered into the docket in such a way that pages are upside down and paragraph 24 is not visible. Plaintiff is requested to file a correctly formatted version of the Complaint by May 31, 2024.The attached Scheduling Order was entered setting deadlines for discovery and other pretrial proceedings. The parties are directed to file a joint status report by August 6, 2024 reporting on the progress of discovery. If the parties are unable to reach an agreement through direct negotiations, a settlement conference will be held on September 19, 2024 at 2:00 pm in Courtroom 11C South, before Magistrate Judge Peggy Kuo. Plaintiff must be present. A representative of the defendants with complete settlement authority (other than counsel) must be present, and are granted leave to participate by phone. The parties are directed to submit confidential ex parte settlement statements to Kuo_Chambers@nyed.uscourts.gov by September 13, 2024. The statements must include the last offer and demand, and a frank assessment of the strengths and weaknesses of each party's case. For guidance on the requirements for the statements, the parties should consult Magistrate Judge Peggy Kuo's Individual Practice Rules. The Court will schedule ex parte telephone calls with counsel after review of the statements. The parties are reminded that, as part of the EDNY Direct Assignment Pilot Program, if all parties consent by June 24, 2024, Magistrate Judge Kuo will remain as the presiding judge in this case and conduct all proceedings including trial. See Federal Rule of Civil Procedure 73 and Local Rule 73.1. The parties may withhold their consent without adverse substantive consequences.
