ORDER: The Court held the initial conference in this matter on September 5, 2024. Jacob Louis Levine appeared on behalf of plaintiff and Jonathan S. Chernow appeared on behalf of defendant. The Court set the following deadlines: any motion to amend the pleadings or join new parties or a motion for a protective order shall be filed by September 30, 2024. Fed R. Civ. P. 16(b)(3)(A). The parties shall file a joint status letter by that same date and the parties shall complete all discovery by January 31, 2025. Any premotion conference request shall be made by February 28, 2024.The parties may consent to Magistrate Judge jurisdiction pursuant to the Pilot Program under Administrative Order 2023-23. If they consent, the parties shall file the consent form by October 5, 2024. The form is available here: https://www.nyed.uscourts.gov/edny-direct-assignment-pilot-program. If no consent form is filed, I shall direct the Clerk of Court to assign this matter to a District Judge. The Court strongly encourages the parties to discuss settlement. ECF No. #1 Defendant answered the complaint on that same day. ECF No. #2 .The Court shall hold the initial conference on September 5, 2024 at 11:00 a.m. in Courtroom 11A South of the United States Courthouse, 225 Cadman Plaza East, Brooklyn, New York. The parties shall exchange their Rule 26(a)(1) initial disclosures and file a 26(f) Meeting Report by August 28, 2024.
