October 9, 2024 Opinion or Order Filing 4 ORDER Plaintiff's request to proceed in forma pauperis pursuant to 28 U.S.C. 1915 is granted. Plaintiff's claims under the Freedom of Information Act are dismissed for failure to state a claim pursuant to 28 U.S.C. 1915(e)(2)(B), and his claims under New York's FOIL are dismissed without prejudice pursuant to Fed. R. Civ. P. 12(h)(3). The Court certifies pursuant to 28 U.S.C. 1915(a)(3) that any appeal from this order would not be taken in good faith and therefore in forma pauperis status is denied for the purpose of an appeal. See Coppedge v. United States, 369 U.S. 438, 444-45 (1962). The Clerk of Court is respectfully requested to enter judgment and to mail copies of this Order and the Judgment to Plaintiff and to note the mailing on the docket. Ordered by Judge Orelia E.
