October 7, 2024 Opinion or Order ORDER - Per the Court's September 22, 2024 order, Plaintiff was ordered to file proof of service by October 4, 2024. No proof of service was filed. Plaintiff shall file proof of service by October 8, 2024. The Court reminds Plaintiff that Plaintiff's counsel's pro hac vice motion shall be filed by October 11, 2024. Ordered by Magistrate Judge Joseph A. Marutollo on 10/7/2024. (EG)
September 22, 2024 Filing 7 Letter to Judge Marutollo by South King Deli & Grocery Corp. (Bahgat, Joseph)
September 22, 2024 Opinion or Order ORDER - The Court is in receipt of Plaintiff's September 22, 2024 letter (Dkt. No. #7 ). The letter appears to take issue with the Court's expedited schedule regarding service and Plaintiff's counsel's admission to the Eastern District of New York. See Dkt. No. #7 at 2 ("Indeed, in the many dozens of cases in which I have appeared pro hac vice[,] this is the first time I can recall being directed to file the application prior to the defendant's answer"). Any exigency here is rooted in the Complaint, in which Plaintiff requests "an emergency stay of the agency's imposition of sanctions against plaintiff prior to the expiration of the statutory period for initiating this judicial review." Dkt. No. #1 . Plaintiff, however, has not sought any emergency relief. Instead, as set forth in Plaintiff's letter (Dkt. No. #7 ), Plaintiff seeks an extension of the Court's deadline to serve the Government and an extension of time to seek pro hac vice admission. As Plaintiff is not seeking emergency relief at this stage, the Court will extend the deadlines accordingly. Plaintiff shall file proof of service by October 4, 2024. Plaintiff shall file his motion for pro hac vice by October 11, 2024. Ordered by Magistrate Judge Joseph A. Marutollo on 9/22/2024. (JAM)
September 21, 2024 Opinion or Order ORDER - The Court ordered Plaintiff to file proof of service against the United States by September 20, 2024. Plaintiff failed to do so. Plaintiff shall file proof of service by September 23, 2024. Failure to comply with Court orders may result in sanctions. In Plaintiff's letter (Dkt. No. #6 ), Plaintiff states that he cannot file a motion for pro hac vice admission because he does not have an updated certificate of good standing from Pennsylvania. It is not clear why it will take "three to four weeks" (Dkt. No. #6 ) for counsel to obtain a certificate of good standing. Plaintiff also does not explain how it can proceed in this litigation if counsel is not admitted in this district and is not seeking to file a motion for pro hac vice admission for at least another three to four weeks. Plaintiff's counsel shall file a letter by September 24, 2024 detailing what steps have been taken to obtain pro hac vice status and proposed next steps. Ordered by Magistrate Judge Joseph A. Marutollo on 9/21/2024. (JAM)
