Filing 15 ORDER DISMISSING CASE: Therefore, the court DISMISSES this case pursuant to Rule 4(m). In the alternative, the court DISMISSES this case for failure to prosecute as Plaintiff's non-response to the court's Order has caused a delay of almos t nine months, the potential defendants would be prejudiced by further delay from an extremely stale case, Plaintiff has had a long period of time-and specific instructions on how-to have his day in court, and the court is aware of no lesser sanction that is available. See U.S. ex rel. Drake v. Norden Sys., Inc., 375 F.3d 248, 254 (2d Cir. 2004). The Clerk of Court is directed to close this case. So Ordered by Judge Nicholas G. Garaufis on 7/31/2012.
