ORDER granting in part and denying in part 65 Motion for Summary Judgment; granting in part and denying in part 71 Motion for Summary Judgment. IT IS HEREBY ORDERED that, for the reasons set forth in the attached Memorandum and Order, the Court denies the motions of defendants Halpern and Pecorale for summary judgment on plaintiff's fraud and breach of fiduciary duty claims but grants the motions on plaintiff's claim under § 349 of the New York General Business Law. The Cour t also denies defendant Pecorale's motion for summary judgment on defendant Halpern's cross-claim for contribution, but grants Pecorale's motion on defendant Halpern's cross-claims for contractual and common law indemnification. SO ORDERED. Ordered by Judge Joseph F. Bianco on 2/19/2010. (Quigley, Brendan)
