MEMORANDUM OF DECISION AND ORDER - It is hereby ORDERED, that the MarineMax defendants motion for partial summary judgment based on the exculpatory clause of the Winter Storage Program contracts is denied without prejudice; and it is further ORDERED, that the MarineMax defendants motion for summary judgment against plaintiff Mallette based on the General Release and Agreement is denied without prejudice; and it is further ORDERED, that the MarineMax defendants motion for leave to file a Third Party Complaint is granted.
