Filing 27 ORDER granting 14 Motion to Dismiss; terminating 14 Motion to Stay. For the reasons stated in the attached Memorandum & Order, defendants' motion to dismiss the amended complaint, for lack of subject matter jurisdiction, is GRANTED. Howeve r, because plaintiff has made a motion to amend to correct the jurisdictional defect in a Second Amended Complaint, the Court requires additional briefing to address the proposed amendment, including whether it would cure subject matter jurisdiction deficiencies. Accordingly, IT IS FURTHER ORDERED that the parties participate in a telephone conference on Tuesday, September 8, 2009 at 2:00 p.m. to establish a schedule for the parties to submit additional briefing regarding whether the Court shou ld grant leave to the plaintiff to submit a Second Amended Complaint pursuant to Rule 15(a)(2) of the Federal Rules of Civil Procedure. At the appropriate time, counsel for plaintiff shall initiate the call by getting counsel for defendants on the line, and shall then contact Chambers at (631) 712-5670. SO ORDERED.
