Filing 35 AMENDED MEMORANDUM AND ORDER: This Amended Memorandum and Order replaces and vacates the Courts prior Memorandum and Order dated August 8, 2012. (See docket no. 34 .) See footnote 2 of the attached opinion for details. As previously held, defendants ' motion for summary judgment is granted as to plaintiffs' claims for retaliation under the ADEA and NYSHRL which are dismissed with prejudice. Additionally, the Court declines to exercise subject matter jurisdiction over plaintiff's claim for defamation. The Clerk of Court is directed to close this case. Ordered by Judge Denis R. Filing 10 ORDER granting in part and denying in part 9 Motion to Dismiss : Defendants' motion to dismiss the complaint is granted as to (1) all ADEA claims as against Druckman; (2) the ADEA and NYSHRL claims for hostile work environment; (3) the defamat ion claim arising from the June 2007 e-mail; (4) the claims for abuse of process, malicious prosecution, intentional infliction of emotional distress and prima facie tort; and (5) the New York State Whistle Blower claim. The motion is denied as to ( 1) the claims against the District under the ADEA and the NYSHRL for retaliation; (2) the claim against Druckman for retaliation under the NYSHRL; and (3) the defamation claim arising from Druckman's allegations regarding the head tapping incident and her September 27, 2009 report.
