Filing 61 ORDER granting 40 Motion to Dismiss; denying 43 Motion to Dismiss for Lack of Jurisdiction: For the reasons set forth in the attached Memorandum and Order, IT IS HEREBY ORDERED that defendant Stark and Grammnet Productions' motion to dismiss for lack of personal jurisdiction is DENIED. The motion to dismiss plaintiff's cause of action under the Copyright Act, filed by all defendants, is GRANTED. IT IS FURTHER ORDERED that plaintiff shall submit a second amended complaint within thirty days of this Memorandum and Order providing a basis for diversity jurisdiction over the remaining state claims.
