IT IS HEREBY ORDERED that, for reasons set for th in the attached Memorandum and Order, the Court grants defendant's motion for summary judgment in part and denies it in part. Specifically, the Court grants summary judgment on the race discrimination claims under federal and state law and o n the ADA claim. The Court denies summary judgment on the FMLA claims and the NYSHRL disability claim. Finally, the Court denies plaintiff's cross-motion for summary judgment in its entirety. The parties shall participate in a telephone confe rence on Tuesday, July 20, 2010 at 10:00 a.m. to schedule a trial date on the remaining claims. At that time, counsel for defendant shall initiate the call and, once all parties are on the line, contact Chambers at (631) 712 5670. SO ORDERED. Ordered by Judge Joseph F. Bianco on 7/9/2010.
