Filing 43 Minute Order for proceedings held before Magistrate Judge A. Kathleen Tomlinson: Status Conference held on September 17, 2009. I met with the parties today for the regularly scheduled Status Conference and to address several outstanding discovery mo tions. (1) In light of today's rulings, I find that Defendants are entitled to discovery on the issue of Plaintiffs' damages in the underlying state court action. Accordingly, by September 30, 2009 the parties are to meet and confer on th e appropriate scope of discovery going forward, which will include discovery regarding Plaintiffs' damages in the underlying case. (2) 20 Plaintiffs' Motion to Quash a third-party subpoena is DENIED and the temporary stay [DE 36] of thir d-party Callan's obligation to comply with the subpoena is hereby lifted. (3) Decision on 28 Plaintiffs' Motion to Compel is RESERVED. (4) 29 Plaintiffs' Motion for leave to amend the Complaint, with regard to Plaintiffs' mo tion to withdraw their claim for indemnification, I am respectfully recommending to Judge Platt that the motion be granted, and will issue a Report and Recommendation setting forth my findings. With regard to Plaintiffs' motion to add OBIG as a Defendant, I am RESERVING decision on this issue and will render a ruling shortly. SEE ATTACHED ORDER FOR additional rulings and directives.
