Filing 66 MEMORANDUM AND ORDER granting in part and denying in part 50 Motion for Summary Judgment; denying 23 Motion for Summary Judgment. For the foregoing reasons, Plaintiff's motion for partial summary judgment is DENIED, and Defendant's cross-motion for summary judgment is GRANTED IN PART AND DENIED IN PART.
