March 19, 2013 Opinion or Order Filing 57 MEMORANDUM AND ORDER granting 51 Motion to Dismiss for Failure to State a Claim. For the aforementioned reasons, the claims against Officer Barten and Officer Roman are DISMISSED WITH PREJUDICE. Thus, Plaintiff's only remaining claims are those against the County for deliberate indifference of medical needs and his claims against Dr. Watson. Accordingly, the County is ORDERED to file a responsive pleading to the Amended Complaint on the sole remaining claim against it on or be fore April 8, 2013. Plaintiff is ORDERED to provide the Court and Defendants with any information regarding the specific dates and the approximate times that Plaintiff visited "Dr. Watson" at the NCCC and any other information relevant to potential identification of Dr. Watson. If Plaintiff fails to provide this information on or before April 22, 2013, his claims against Dr. Watson will be dismissed. If Plaintiff does provide such information, within fourteen (14) days of rece ipt of the information, defense counsel shall provide contact information for her so that the Marshals Service may attempt to re-serve process, or provide a sworn affidavit informing the Court that a Dr. Watson cannot be identified. The Court cer tifies that pursuant to 28 U.S.C. § 1915 (a) (3) that any appeal from this Order would not be taken in good faith and therefore in forma pauperis status is denied for the purpose of any appeal. The Clerk of the Court is directed to terminate Barten and Roman as Defendants in this action and mail a copy of this Order to prose Plaintiff. So Ordered by Judge Joanna Seybert on 3/19/2013. February 16, 2012 Opinion or Order Filing 48 MEMORANDUM AND ORDER granting in part and denying in part 30 Motion for Judgment on the Pleadings. Based on the foregoing discussion, the Moving Defendants' motion for judgment on the pleadings is GRANTED IN PART AND DENIED IN PART. All of P laintiff's claims against the Moving Defendants except for the deliberate indifference to medical needs claim against Nassau County are dismissed. Additionally, Plaintiff's claims against Dr. Watson survive inasmuch as Dr. Watson has not ap peared to defend this case. Plaintiff may file an Amended Complaint against all Defendants within thirty (30) days from the date of this Order. Counsel for the Moving Defendants is directed to, within fourteen (14) days, inform the Court whether the y know if Dr. Watson works for NUMC. The Clerk of the Court is respectfully directed to update the docket sheet to add Nassau County in the place of the "Nassau County Sheriff" and to mail Plaintiff a copy of this Order. For the reasons set forth herein, Plaintiff's motion to proceed in forma pauperis is GRANTED.
