ORDER granting 18 Motion to Dismiss and Motion for Summary Judgment. IT IS HEREBY ORDERED that, for the reasons in the attached Memorandum and Order, the Court grants defendants' motion to dismiss the plaintiff's common law claims for br each of contract and unjust enrichment, and defendants' motion for summary judgment, pursuant to Federal Rule of Civil Procedure 56, on plaintiff's ERISA claim.
