Filing 32 ORDER granting in part and denying in part 21 Motion to Dismiss. For the reasons set forth in the attached Memorandum and Order, defendants' motion to dismiss, pursuant to Federal Rule of Civil Procedure 12(b)(6), is granted in part and denie d in part. With respect to the corporate defendants, the motion is denied as to (1) the federal and state age discrimination claims relating to the three alleged suspensions; (2) the state retaliation claim arising from the alleged 2007 protected ac tivity; and (3) the federal and state hostile work environment claims. With respect to the individual defendants, the motion to dismiss the state claim against them under Section Section 296 is denied. The motion is granted as to all other claims. The parties shall proceed with discovery under the direction of Magistrate Judge Tomlinson. SO ORDERED. Ordered by Judge Joseph F. Bianco on 10/28/2010. (Graves, Kelly) |
