ORDER: SO ORDERED that the branches of defts' 21 motion pursuant to Rule 56 of the Federal Rules of Civil Procedure seeking summary judgment dismissing plaintiffs federal and state law false arrest and imprisonment and malicious prosecution cl aims are granted and those claims (first and third causes of action), as well as plaintiffs state law negligence claim (second cause of action), are dismissed in their entirety with prejudice, and defts' motion is otherwise denied as moot; and p laintiff's 25 cross-motion, inter alia, pursuant to Rule 56 of the Federal Rules of Civil Procedure seeking partial summary judgment on his false arrest claims is denied. The Clerk of the Court shall enter judgment in favor of defts, close thi s case and, pursuant to Rule 77(d)(l) of the Federal Rules of Civil Procedure, serve notice of entry of this order upon all parties in accordance with Rule 5(b) of the Federal Rules of Civil Procedure.
