June 21, 2010 Opinion or Order Filing 5 MEMORANDUM AND ORDER granting 2 Motion for Leave to Proceed in forma pauperis. For the reasons set forth above, the Plaintiff's application to proceed in forma pauperis is granted, the Complaint is sua sponte dismissed without prejudice and w ith leave to file an Amended Complaint that complies with Federal Rule of Civil Procedure 8 and in accordance with this Order by July 30, 2010. Plaintiff is warned that failure to file an Amended Complaint within this time period will result in dismi ssal of his Complaint with prejudice pursuant to Federal Rule of Civil Procedure 41(b). The Court certifies pursuant to 28 U.S.C. § 1915(a)(3) that any appeal from this Order would not be taken in good faith and therefore in forma pauperis status is denied for the purpose of any appeal.
